Most people hurt in a motor vehicle accident wants to know what their claim is worth. While most experienced personal injury attorneys can estimate a range wherein your claim falls, there is no attorney who can accurately determine your case value without carefully reviewing your complete medical expenses, medical records, lost wages and permanent injuries, if any, and various other pertinent factors that affect your case value.

 

When you are involved in a motor vehicle collision that is not your fault, you should take steps to protect your rights and to protect yourself, especially if you are not represented by an attorney. First, if you are in pain and believe you have received bodily injuries as a result of the collision, you should seek medical treatment promptly. Simply staying home and taking pain medications without any documentation from a medical doctor that you were injured will make it easy for the insurance adjuster to claim that you were not really hurt. In legal world, if your injuries are not documented in medical records, they do not exist. For the same reason, it is always a good idea to take pictures of any visible injuries you sustained because bruises, cuts, and abrasions heal quickly and fade away. Remember, the adjuster’s job is to pay you as little as possible for your injuries. Insurance companies are, after all, in the business of collecting premiums while trying not to pay out claims.

 

Use your personal health insurance policy to pay all the medical bills you incur. The at-fault driver’s (liability) insurance carrier will generally pay money only when you are ready to settle your entire personal injury claim. If you don’t pay your medical bills but decide to wait, expecting the liability carrier to pay them, you will most likely receive collection letters from your medical providers and the unpaid medical expenses will eventually affect your credit score. Also, when your health insurance pays the medical expenses you will benefit financially because most health insurance plans are not entitled to reimbursement from your personal injury settlement but you are still allowed to make a claim for the full amount that was billed (not just what you paid from your own pocket).

 

If you do not have health insurance and can’t afford to pay your medical bills out of your own pocket, you should contact us for assistance. However, without an attorney involvement you will most likely not find any medical providers willing to treat you without being paid at the time of the service.  

 

Your property damage is a separate claim from your personal injuries and can be resolved relatively quickly after liability (fault) has been established. If you have collision coverage under your own policy, it is often much faster to resolve this claim through your own insurance than the liability insurance. If the accident was not your fault, then your insurance premiums will not increase just because you made a claim. Further, your insurance carrier will get its money back from the at-fault driver’s insurance carrier and will then reimburse you for your deductible. Property damage is relatively simple to resolve. If your car is deemed a total loss, then you should receive enough money to buy a similar vehicle in your locale. On the other hand, if your vehicle is repairable, then the repairs need to be performed in a manner that properly fixes all the damages caused by the collision.

Order the police report and any other investigative agency reports applicable. We will also interview witnesses, if needed to determine liability.

 

Find medical providers for you who are willing to wait for payment until your case settles, if needed, and will monitor your medical treatment progress and your healing process.

 

Order your complete medical bills and records from all your medical providers who have treated your injuries and analyze the documentation so that we can properly educate the insurance carrier about your injuries and damages.

 

Order lost income documentation from your employer or assist you in gathering the information, if self-employed.

 

Identify and evaluate any and all medical provider liens and health insurance subrogation issues and resolve these claims after the case settles.

 

Determine strengths and weaknesses in your case and evaluate the value of the case. Prepare demand to the insurance carrier with applicable exhibits and discuss the case value and demand amount with you, our client, prior to sending a demand to the adjuster.

 

Negotiate with the adjuster and inform you of the progress. If the case settles, we will then resolve claims against the settlement by any medical providers, health insurance carriers or others. If you do not want to settle your claim, you have the option to proceed into litigation through which we will continue to be your attorneys.
